Colorado has seen a dramatic rise in anger and venom towards those accused of Driving Under the Influence (DUI) over the course of 2009. The Denver Post and some cooperating District Attorneys offices throughout the state have been working hard to bring tougher DUI penalties to Colorado.

Lately, I have been seeing a lot of articles on Driving Under the Influence (DUI) charges. I'm sure you have noticed them as well. However, without being the criminal justice system day in and day out, like a criminal defense attorney, one may not understand the far reaching implications of these articles. These articles are both harsh and unfair. The harshly characterize people charges with DUI as career criminals with little to no regard for human life. They are unfair because they lump everyone that gets a DUI or even multiple DUI's into the same category. Anyone who spends anytime with a large number of people charged with DUI's quickly learns that they cannot all simply be placed into any category. People charged with DUI come from all walks of life and have a myriad of issues that have brought them to be charged. In some cases, people are charged with a DUI unjustly.

DUI & DV (Domestic Violence) Dismissal

Often times the first issue raised by our clients is the possibility, or lack thereof, of their case being dismissed. This is a particularly tough question to answer when one is charged with Driving Under the Influence (DUI) or any number of Domestic Violence (DV) charges. The legislature has carved out exceptions for these types of charges that make dismissal a much less easy remedy for a District Attorney or Court to agree to. In order for a Domestic Violence or Driving Under the Influence charge to either be dismissed or taken out of the alcohol or domestic violence realm which they are charged under, a finding must be made by the Court that District Attorney could not prove the case beyond a reasonable doubt.

DUI and the Holidays

The first thing most people think of when you mention the holidays are the all too fun holiday parties that are lined up with food and drink to spare. This is a chance for you and your friends to unwind get some stress out and maybe have a few Christmas Ales, perhaps a little Brandy in the old Eggnog, or maybe a few different drinks to get the edge off. Well, keep in mind that the police are also aware of this fact and ready to test you for that DUI or DWAI (Driving While Ability Impaired which is a lesser form of DUI).

DUI and How It Will Affect Your Driver's License in 2009

Drivers accused of Driving Under the Influence in Colorado will face stiffer consequences come January 1, 2009. Currently adult drivers who are enduring their first DUI accusation (called a "per se revocation") face the possibility of losing their privilege to drive for three months. If those driving privileges are revoked then that driver would be eligible after thirty days to request a Probationary Drivers License (a.k.a. "PDL" or "Red License"). All of that is about to change come the new year.
